LIABILITY AND PUBLICITY RELEASE

I will attend and participate in the program organized and operated by the Finger Lakes Museum (“FLM”).

As a condition of participating in the Program, I hereby (1) assume any and all risks arising out of or in any way relating to my participation in the Program and (2) on behalf of myself and my survivors, heirs, estate, executors, personal representatives, and assigns release and hold harmless FLM and its trustees, officers, employees, volunteers, agents, contractors and vendors, past, present and future, and each of them, from any and all claims, damages, liabilities, actions or causes of action (including without limitation those relating to personal injury, property damage or wrongful death) that I have or may ever have, whether known or unknown, and whether anticipated or unanticipated by me, arising out of a failure to use reasonable care or any other negligent acts related to, arising out of or in any way relating to my participation in the Program or the use of Photographs (as defined below) or my name, voice, and likeness as described below (including claims for invasion of privacy, rights of publicity, defamation, false light, or misappropriation of my name or likeness or similar claim under any legal or equitable theory).

I hereby irrevocably grant FLM and its contractors and agents (1) the right to take photographs and make recordings of me (collectively, “Photographs”) during and in connection with the Program and (2) the royalty-free, worldwide, perpetual right to reproduce, distribute, create derivative works of, publicly display and perform the Photographs in all media (now known or later developed) for any purpose related to FLM or the Program, including advertising, educational, commercial, and fundraising purposes.

I hereby certify that I have read, understand and agree to be bound by this Liability and Publicity Release.  I further certify that either (1) I am 18 years of age or older or (2) if I am under the age of 18, my parent or legal guardian has agreed to this statement.
